RCB ARE IN THE COURT OF APPEAL

RCB are in the Court of Appeal on 1 May 2013, attending the appeal of a first instance decision in the County Court at which RCB successfully defended a solicitors’ professional negligence claim worth £300,000. The case revolves around the solicitors’ alleged negligence at two mediation meetings arranged to enable two business partners to divide up their various businesses and associated assets after a breakdown in their business relationship. One of the partners, the Claimant/Appellant, alleged the solicitors failed to prepare an enforceable agreement at the first mediation and failed to consider the tax consequences of the business division, thereby leaving him with a less favourable agreement and a considerable tax bill. The Trial Judge dismissed the entire claim, the Claimant is now appealing that decision.
