We have advised on mis-selling claims across the full range of financial products including pensions, investments, mortgages, and insurance. We have also advised investment and retail banks, trustees, and pension administrators, as well as their insurers, in relation to claims and their policy wordings.
We are able to deal with the full range of claims which financial professionals face, ranging from high value multi-party proceedings to complaints brought via the Financial Ombudsman. We understand the broader commercial and regulatory landscape in which claims arise and the FCA`s requirements as regards the handling of customer complaints.
We have defended accountancy related claims, whether brought against a top ten firm or a sole practitioner. We have defended auditors when allegations of negligent tax advice have been made, or involvement in tax avoidance schemes as well as when acting as administrators and/or receivers in insolvency situations.
Our experience includes:
- Advising a top ten accountancy firm in relation to allegations of wrongful interference and conversion made against two of its partners, when acting as receivers, which ended in successful outcomes in both the Court of Appeal and House of Lords.
- Advising reinsurers as to coverage following a multi-million fidelity claim by a captive Turkish insurer of a Turkish bank. We successfully negotiated settlement with the reinsured for a fraction of the reserve held by reinsurers.
- Advising a Luxembourg based financial institution in relation to mis-selling allegations which involved successfully challenging jurisdiction under the Brussels Regulations and striking out a €2 million claim.
